1. Purpose
Weave is a home-care coordination application, accessible through a web site and
mobile applications. The service allows a group of people (the "circle") to share
tasks, medication treatments, documents, expenses and messages relating to the care
of a fragile loved one (the "care recipient").
These Terms govern the relationship between schoenfg (a French sole
trader, registered office Grenoble 38000, France · SIRET 102 432 242 00018 · registered
with the French National Business Register (RNE), Grenoble registry · Intra-EU VAT
FR59102432242), publisher of the Weave service, and any user of the service, whether
they are a family caregiver, healthcare professional, observer or administrator.
2. Access to the service
The service is available 24/7, subject to maintenance operations of which you will
be informed where possible. schoenfg does not guarantee 100% availability and
cannot be held liable for occasional outages, in particular in the event of force
majeure or failure of a third-party operator (hosting provider, ISP).
3. User account
3.1. Creating an account
Account creation requires a valid email address and a password of at least 8
characters. The user undertakes to provide accurate information and to keep it
up to date.
3.2. Security
The user is solely responsible for keeping their credentials confidential. In the
event of loss or suspicion of compromise, they must reset their password
immediately and notify Weave at contact@schoenfg.com.
3.3. Minimum age
User-account creation is reserved for persons aged 15 or older, the French digital-
consent threshold under article 7-1 of Act n°78-17 of 6 January 1978 as amended.
Age is declared on first login; the timestamp of that confirmation is recorded as
evidence in case of review.
Where the circle's care recipient is a minor under 15, circle creation requires the
explicit consent of a holder of parental authority or legal representative, gathered
at creation time and recorded in the application. Where the care recipient is under
a legal protection measure (guardianship, curatorship, family empowerment, future-
protection mandate), the type of measure and the identity of the legal representative
are also recorded.
4. How the circle works
Each circle is attached to a care recipient and brings together several members with
distinct roles:

| Beneficiary | The care recipient themselves, if they have an account; scope adapted to their situation and privacy preferences. |
The "observer" and "pro" roles that existed in previous versions have been removed;
affected members have been automatically re-mapped to the "helper" role.
The admin is responsible for proper use of the circle and stands behind the invitations
sent. Any member may leave the circle at any time; their past contributions remain
visible to other members.
5. Weave+ subscription
The Weave+ subscription applies to the circle, not the user. Price:
€14.99 incl. VAT per month (French 20% VAT included, i.e. €12.49 ex. VAT).
One subscription unlocks all features for every current and future member of the
circle.
Monthly subscription, no minimum term. Payment is charged each month
on the anniversary date of the subscription, on the payment method registered at
the time of subscription.
5.1. Subscription and payment
Subscription is taken out directly inside the application via a secure payment form.
Payment-card data is transmitted encrypted (TLS) to our payment processor
Stripe Payments Europe Ltd (Ireland); it never transits through the
publisher's servers and is not stored by schoenfg. Payment is compliant with the
PCI DSS standard and the PSD2 directive
(3D Secure strong customer authentication).
5.2. Invoicing
An invoice is issued for every successful payment, with continuous unique numbering
in accordance with article L.441-9 of the French Commercial Code. Invoices can be
consulted and downloaded at any time from the billing portal accessible through the
circle settings. They are kept for 10 years (article L.123-22 of the Commercial Code).
5.3. Cancellation and refunds
The subscription can be cancelled at any time from the circle settings or via the
billing portal. Cancellation takes effect at the end of the current paid period:
Weave+ access remains active until the renewal date, after which
the circle automatically switches back to the Free plan with no data loss.
No prorated refund is issued, except in the event of a fault attributable to Weave.
5.4. Failed payment
In the event of a failed charge (expired card, limit exceeded, etc.), Stripe runs
several automatic retries over 7 days. You are notified by email at each attempt
and can update your payment method via the billing portal. Without a successful
payment within 14 days, the subscription is suspended and the circle reverts to
the Free plan.
5.5. Right of withdrawal
In accordance with article L.221-18 of the French Consumer Code, a consumer in
principle has 14 days to withdraw from a contract concluded at distance.
However, pursuant to article L.221-25 of the French Consumer Code,
a consumer who expressly requests immediate provision of a service
expressly waives their right of withdrawal for the part of the service
already performed. At the time of subscription, you request immediate activation
of the Weave+ service and expressly accept this waiver, via a dedicated
and separate checkbox, independent of the acceptance of these Terms.
This explicit consent is kept in our audit logs. You can cancel your subscription
at any time (see 5.3) — waiving the right of withdrawal does not affect your
ability to terminate the contract at any time.
6. Emergency relay
Weave's emergency relay does not in any way replace emergency services.
In a life-threatening emergency, immediately dial your local emergency number:
15 (SAMU) or 18 (fire) in France,
112 (European number), 911 in the US.
Phase 1 — internal circle relay. The "emergency relay" feature
alerts the other members of the circle. The first available member responds and
takes over. schoenfg does not guarantee that a member will always be available
and disclaims all liability regarding the internal organization of the circle.
Phase 3 — agency marketplace (upon activation). When the
connection feature with partner home-care agencies is activated, triggering a
request may result in a paid service charged by bank card via Stripe. Detailed
pricing, real-time geolocation of the responder (subject to express consent that
can be revoked at any time) and the issuance of the 50% tax-credit certificate
will be described in a specific addendum to these Terms, communicated to you before
any commitment. Each partner agency is bound by a joint-controllership agreement
compliant with article 26 of the GDPR, signed with schoenfg before activation.
7. User content
You remain the owner of all content you publish on Weave (messages, photos,
documents, sticky notes). You grant schoenfg a non-exclusive license, limited
to what is strictly necessary to operate the service (storage, display,
transmission to circle members).
Strictly forbidden: unlawful content, discriminatory speech, hateful content,
harassment, counterfeiting, infringement of others' privacy. Any breach may lead
to suspension of the account without prior notice.
8. Liability
Weave is a coordination tool, not a medical device. Medication reminders, shared
tasks, condition tracking have no prescriptive value and do not
replace the advice of a healthcare professional.
schoenfg undertakes to use reasonable means to ensure the security and availability
of the service. schoenfg's liability is expressly limited to the amount actually
paid by the user over the previous 12 months.
9. Termination
You may terminate your account at any time from the settings. Termination proceeds
by anonymization: your personal identity (name, email, phone,
picture) is immediately erased. Your past contributions to the circle (messages,
memories, completed tasks) are preserved under the generic identity "Deleted user",
so that other members keep a coherent history of the circle.
Kept beyond termination, in accordance with legal obligations: invoices (10 years,
article L.123-22 of the French Commercial Code), audit traces relating to GDPR
rights exercised (5 years, as evidence) and medical documents of the circle falling
within the HDS framework (20 years after the last activity, article R.1112-7 of
the French Public Health Code).
schoenfg may terminate an account in the event of serious breach of these Terms,
after a formal notice that has remained unanswered for 14 days.
10. Governing law
These Terms are governed by French law. Any dispute will fall under the jurisdiction
of the competent courts of Grenoble, subject to mandatory provisions applicable to
consumers.
